  • (For DIVORCE & SEPARATION clients only) When you get a divorce in Nevada... the court requires that you have a person sign a short, 2-page document... that states that they have seen you actually physically living within the state for at least 6 weeks. That person can be anybody (a friend, relative, co-worker, associate, next-door neighbor, etc.)... and must be at least 18 years old... must not be a involved with your divorce case... and cannot be yourself or your spouse. Please list the full name of the person you want to use as your residency witness. If you are unsure of who you will use... please put "UNSURE"... and we will leave that area blank on your divorce papers... so that you can write in the name of your witness at a later date.

  • (For ANNULMENT clients only) When we prepare an annulment for you, we need to state a reason that is acceptable in the state of Nevada for you seeking an annulment. Read the grounds for annulment below... a. There is a close enough blood relationship between you & your spouse that the marriage is prohibited by law. --- b. You or your spouse were married to someone else on the day of the wedding ceremony. --- c. You were under the age of 18 at the time of the marriage ceremony and did not get the proper consent from your parents, guardians, and/or district court. (NOTE: You must file the annulment within ONE year of you turning 18 years old AND you must not have lived with your spouse since that time.) --- d. You lacked understanding of your actions the day/night you were married... to the extent that you were incapable of agreeing to the marriage. (i.e. You were intoxicated, under the influence, etc) --- e. You were insane at the time of the wedding ceremony and have since regained sanity. Since you regained your sanity, you & your spouse haven’t lived together. --- f. Your marriage was based off of fraud & you would not have married your spouse had the truth been out there. (NOTE: If this is the ground for annulment... many times the judge will ask for you to appear at the hearing before the annulment is granted. If this happens in your case, we can arrange to have you attend via the telephone)

  • Nevada is a community property state. This means that MOST property (except for gifts & inheritances)... that you and your spouse acquired during your marriage is joint property... which means that it will be divided equally between the two of you.

    Any property that you and your spouse acquired BEFORE your marriage... is your individual property.

    The exception to this... is if you and your spouse both agree that certain property shall go to you... and certain property shall go to your spouse. IF THIS IS THE CASE... then you may divide your property any way you & your spouse see fit... as long as you are both in agreement.

    The Nevada Legislature re-wrote the child support statutes, including the formulas to calculate the same. These new guidelines are codified in Nevada Administrative Code (NAC) section 425 and became effective February 2020. While many aspects surrounding child support have changed, the formulas and guidelines still use the gross, pre-tax (or adjusted gross for self-employed parents) monthly income of the obligor.

    For one child:
    (a) 16% of the first $6,000 of gross monthly income;
    (b) 8% of gross monthly income between $6,000 and $10,000; and
    (c) 4% of gross monthly income that is greater than $10,000.

    For two children:
    (a) 22% of the first $6,000 of gross monthly income;
    (b) 11% of gross monthly income between $6,000 and $10,000; and
    (c) 6% of gross monthly income greater than $10,000.

    For three children:
    (a) 26% of the first $6,000 of gross monthly income;
    (b) 13% of gross monthly income between $6,000 and $10,000; and
    (c) 6% of gross monthly income greater than $10,000.

    For four children:
    (a) 28% of the first $6,000 of gross monthly income;
    (b) 14% of gross monthly income between $6,000 and $10,000; and
    (c) 7% gross monthly income greater than $10,000.

    For each additional child:
    (a) An additional 2% of the first $6,000 of gross monthly income per child;
    (b) An additional 1% of gross monthly income between $6,000 and $10,000 per child; and
    (c) An additional 0.5% of gross monthly income greater than $10,000 per child.

    For perspective, here are some examples (assuming there is only one child):
    If the parent obligated to pay child support has a gross monthly income of $5,800, that parent’s child support obligation is calculated as follows:
    5800 x 0.16 = 928
