If you are currently living in Las Vegas and both you and your spouse have made the hard decision that it is time to split from each other…
…then you may want to consider getting an uncontested Las Vegas divorce.
An uncontested Las Vegas divorce is simply a divorce in which both husband and wife are able to come to an agreement on how they will separate their property and debts.
The couple also decides whether there will be any spousal support or alimony paid to either side.
In an uncontested Las Vegas divorce… the couple if they have minor children… have also agreed on how they will raise their children AFTER the divorce has ended.
This means that both sides agree on the child support amount, visitation and what the custody arrangements shall be.
In the state of Nevada there are TWO main forms of going about a divorce:
(1) If both parties cannot agree, if one spouse cannot be found to sign the divorce paperwork or if one spouse refuses to sign the paperwork… you will typically need to file a COMPLAINT for DIVORCE.
When you hear about people spending thousands of dollars in legal fees and spending months and months in court… nine times out of ten, it is because they couldn’t agree… and were fighting over the kids or over property.
(2) If both parties agree, the uncontested divorce in Las Vegas process… is also known as a JOINT PETITION for DIVORCE.
Both parties in this form of uncontested divorce are the Petitioners… and both will sign and notarize the petition to start the divorce.
If you’re filing an uncontested Las Vegas divorce… you will also need a friend, family member or co-worker who is over the age of 18… not related to the divorce case… and who is a Nevada resident sign a 2 page affidavit.
This affidavit is commonly referred to as the Affidavit of Resident Witness. It basically states that they have seen you actually physically living in Las Vegas for at least six (6) weeks.
You will also need a Decree of Divorce for your uncontested Las Vegas divorce. This is the form that will be signed by the Clark County (Las Vegas) judge… which will effectively grant you and your spouse your divorce in Las Vegas.
Once everything is filed at the Las Vegas court on Pecos Ave… it typically takes about 1 to 3 weeks on average for the judge to sign off on your divorce decree and for it to be filed by the court clerk.
Once this is done… you and your spouse are officially divorced!
