Do I QUALIFY to Get an Annulment in Nevada?

➨ Residency Requirements: You must have either (1) Been married in the state of Nevada, OR (2) Have lived in the state of Nevada for at LEAST 6 weeks to ask for an annulment.

➨ Time Limit for Annulment: There is NO time limit for a person who gets married to ask for an annulment in Nevada law… but judges typically look more favorably towards you if the marriage has been less than a year.

➨ Grounds for a Las Vegas Annulment (no fraud): There are several grounds and reasons that you can ask for an annulment in Las Vegas. Below are a few of the more common reasons that individuals have used in asking for an annulment in Las Vegas…

(a) The husband and wife were intoxicated or under the influence of drugs at the time of marriage… which caused a want of understanding (NRS 125.330) between the parties… and they were incapable of assenting to the marriage.

It would be beneficial to have at least 1 or 2 witnesses sign a sworn affidavit of this fact(that we can prepare for you)… to give to the court. Also, you & your spouse must not have lived together after you came back to your sane minds.

(b) You and your spouse were under the age of 18… and lacked the consent of a parent or guardian (NRS 125.320). You must not have lived with your spouse AFTER reaching 18 years of age… and the annulment must be filed BEFORE you reach the age of 19.

(c) You and your spouse were related by blood to each other… which is also known asconsanguinity between the parties (NRS 125.290)

(d) You or your spouse were already married to another living person… at the time of your marriage. (NRS 125.290)

➨ Grounds for a Nevada Annulment (fraud involved): There are several grounds and reasons that you can ask for an annulment in Las Vegas based off of fraud that can be proven(NRS 125.340). Once you have received knowledge of the fraud… you MUST stop living with your spouse.

You should be able to provide evidence supporting the fact that your spouse committed fraud. This evidence can include documents, receipts or sworn statements from witnesses that are signed & notarized.

Citizenship/Green Card/Illegal Alien Issues
(a) Your spouse married you just to gain citizenship, visa or green card to the U.S.
(b) Your spouse lied to you about their intention on becoming a US citizen after the marriage.

Honesty or Character Issues
(a) Your spouse has an occupation that is disreputable or they have poor moral character.

(h) Your spouse stated that they wanted children before the marriage, but afterwards informed you they did not want children.
(i) Your spouse engaged in abnormal sexual relations with you or another person.
(j) Your spouse had a prior divorce which was due to adultery, which you did not previously know about.
(k) Your spouse stated that they would live with you before the marriage, but afterwards, they refused to live with you.

Religious Issues
(a) Your spouse hid their present religious conviction from you.
(b) Your spouse hid the fact from you that they were previously divorced… and you are Roman Catholic in faith.
(c) Your spouse promised you that they would have a religious ceremony performed after the civil ceremony… but failed to do so.

Option #2 – Annulment Complaint (MEDIUM)


If your spouse DOES NOT agree to the annulment… and you know where they are located at… you typically qualify for a Annulment Complaint.

➨ An Annulment Complaint will need to be filed and served to your spouse at their job or home.

➨ An Annulment Complaint ONLY needs to be signed by you.

➨ As long as your spouse doesn’t reply back to the courthouse… a Annulment Complaint is typically final & signed by the judge within 6 to 8 weeks after all of the proper paperwork has been filed!

➨ PAPERWORK ONLY: We can prepare your Annulment Complaint paperwork for only $299. You would then be responsible to file it at the courthouse yourself (court filing fees are $269) and then getting it served to your spouse. We will give you the instructions on how to file.

Option #3 – Missing Spouse Annulment (HARD)


If your spouse is missing and you can’t find them in order to get them served or to sign the papers… you typically qualify for what we call a Missing Spouse Annulment… (also known as a Publication Annulment).

➨ A Missing Spouse Annulment will need to be mailed to the last known address of your spouse… and then be published in the Nevada Legal News paper for at least 5 weeks.

➨ A Missing Spouse Annulment ONLY needs to be signed by you.

➨ As long as your spouse doesn’t reply back to the courthouse… a Missing Spouse Annulment is typically final & signed by the judge within 10 to 16 weeks after all of the proper paperwork has been filed!

➨ PAPERWORK ONLY: We can prepare your Missing Spouse Annulment paperwork for only $399. You would then be responsible to file it at the courthouse yourself (court filing fees are $269) and then getting it published with the newspaper ($100). We will give you the instructions on how to file and publish.
